States we serve

Healthcare business insurance in California

Serving California home health and hospice agencies, healthcare employers and the staffing firms that place clinicians there. Classification, employment and comp rules here are the toughest in the region.

Workers' compensation in California

California requires workers' compensation for every employer with one or more employees, including part-time. Rates are among the highest in the country and the rules among the most complex. The State Compensation Insurance Fund is available if the private market declines you, but well-run agencies usually get better pricing from private carriers.

AB5 and 1099 workers

California's AB5 can reclassify independent contractors as employees no matter how your contracts are written. Healthcare has some exemptions, but they aren't blanket. If a 1099 caregiver is injured and the state decides they were an employee, the claim is yours whether or not your policy was built to cover it.

Two licensing frameworks

Non-medical home care organizations and Medicare-certified home health agencies are licensed separately, and insurance requirements differ by license type.

EPLI isn't optional

California has the most plaintiff-friendly employment law in the country. FEHA goes beyond federal law, and strict meal, rest-break and overtime rules apply to home care workers. Any agency with California operations should treat EPLI as mandatory.

Higher liability pricing

The litigation environment pushes professional liability and EPLI premiums above the rest of the region.

State rules change. These notes are a general summary, not legal advice. We confirm current requirements for your specific situation.
