Professional Liability

Protects your agency when a patient or family says the care your caregivers or placed clinicians provided caused harm, including negligent credentialing claims.

In plain language

Professional liability, often called malpractice or errors & omissions insurance, pays to defend your organization and settle claims when someone says the care or professional services you provided caused harm.

For home health and hospice agencies the policy needs to fit how you actually deliver care: alone in patients' homes, in assisted living and nursing facilities where you serve residents, and on call at all hours. A good policy covers the agency and, where you choose, your employed nurses, therapists, aides and hospice team too.

One feature matters a lot for in-home care: negligent hiring and supervision coverage. It responds when a family says you sent a caregiver who wasn't properly vetted or supervised (an expired license, a missed background check, an aide who skipped the care plan).

Medical staffing agencies placing clinical staff at healthcare facilities face a distinct risk profile: the placed worker's actions create liability that can flow back to the agency, so the policy form needs to be built for staffing operations, with negligent credentialing coverage.

Typically covers

  • Legal defense costs, even when the claim has no merit
  • Settlements and judgments for injury caused by professional services
  • Negligent hiring, credentialing and supervision allegations (when endorsed)
  • Licensing board defense for employed clinicians (on many policies)
  • Vicarious liability for the acts of employees, volunteers and, on some forms, placed workers

Usually not covered

  • Intentional or criminal acts
  • Abuse or molestation allegations (needs separate Abuse & Molestation coverage)
  • Employee injuries (that's workers' compensation)
  • Contract disputes or billing errors unrelated to patient harm

Coverage depends on the policy form, endorsements and exclusions. We confirm the details in writing before you buy.

What contracts usually require

Hospital referral, nursing facility, managed care and staffing contracts commonly require $1M per claim / $3M aggregate, sometimes more. We read your contracts and match limits so you aren't over- or under-insured. Check your contract →

FAQ

Professional Liability questions

Is professional liability the same as malpractice insurance?

Usually, yes. "Malpractice" is the common healthcare term for professional liability. The policy forms and coverage triggers are essentially the same; the name varies by carrier. Both protect your agency against claims arising from the care and professional services your team provides.

Does my general liability policy cover professional liability claims?

No. General liability covers third-party bodily injury and property damage. It doesn't cover claims that your professional services caused harm. They're separate coverages, and a complete program needs both.

What limits should my agency carry?

Most agencies start at $1 million per claim and $3 million aggregate. Agencies contracting with managed care organizations, hospital systems or government programs are often required to carry more. We set limits based on your contracts and risk profile.

What is a retroactive date on a claims-made policy?

It's the earliest date from which incidents are covered. An incident before the retroactive date isn't covered, even if the claim is filed during the policy period. When you switch carriers, the new policy's retroactive date must match your prior coverage to avoid a gap.

What is negligent hiring or credentialing coverage?

It covers claims that you hired or placed a nurse, aide or therapist without properly verifying their license, background, skills or references. It's essential for medical staffing firms and valuable for every home health and hospice agency, especially with high caregiver turnover, and it isn't automatic on every policy.

Do my independent contractor caregivers need their own professional liability coverage?

It depends on your contracts with them and your policy terms. Some agency policies extend coverage to contractors working on the agency's behalf; others don't. This is one of the most common coverage gaps in the industry, so Misty reviews it specifically for agencies using 1099 workers.

Does professional liability cover regulatory investigations?

Some policies include defense costs for regulatory matters such as state licensing board or CMS investigations. It isn't standard on every policy, so we confirm it when comparing options.
